1. Who is selling to you

This site and the products offered on it belong to Fundrbot, hereinafter “Fundrbot” or “we”. You can write to us at info@fundrbot.com.

By creating an account, starting the free trial or buying any of our products, you accept these terms. If you do not agree with any of them, do not use the service.

2. What you are purchasing

Fundrbot is a technical analysis tool: an indicator that is installed in your TradingView account and, depending on the plan, two extensions—a parameter optimizer for Google Chrome and a tunnel that sends the signals to your execution platform.

3. What you need on your side

• Your own TradingView account. We do not create or manage it.
• A TradingView plan that allows the number of indicators and alerts you intend to use. That relationship is between you and TradingView, and its cost is not included.
• For the execution tunnel, a MetaTrader 4 or MetaTrader 5 account, whether your own or from a prop firm. cTrader and NinjaTrader are in preparation.

4. Your account

You are responsible for your account password and for whatever happens with it. Let us know as soon as you suspect unauthorized access. The information you give us—in particular your email and your TradingView username—must be true and kept up to date: if the TradingView username is wrong, the indicator will end up in the wrong account.

5. Free trial

When you sign up you get 7 days of access to the full indicator, with no credit card and no automatic renewal: when it ends, access simply stops. One trial per person; accounts created to chain trials may be suspended.

6. Price, taxes and payment

Published prices are stated in US dollars and do not include taxes; any applicable taxes are added and shown before you confirm payment. We may change prices at any time, but never with effect on a license that has already been paid.

Payment is confirmed by bank transfer or equivalent, and an administrator activates the license manually. We do not process cards on the site.

7. Duration and renewal

Each purchase gives 12 months of access counted from its activation. It is a one-time payment: it does not renew itself. If you renew before the current license expires, the new 12 months are added to the days you had left; they do not replace them.

8. How it is delivered

The indicator is an invite-only script on TradingView. After paying, you enter your TradingView username in your dashboard and we add that username manually. This normally happens in less than 24 business hours.

Because the authorization is tied to the username, if you change it you will have to tell us again and you will go back into the queue. When the license expires or is cancelled, we remove the access.

The backtest extension is not invite-only. If your plan includes it, you download it from your dashboard as a ZIP for Google Chrome: you extract it to a folder and load it in chrome://extensions with developer mode. It is not installed from the Chrome Web Store.

The execution tunnel is not invite-only either. If your plan includes it, you download the Fundrbot-Setup installer for Windows from your dashboard and run it on the computer where MetaTrader runs. cTrader and NinjaTrader are in preparation. The tunnel lives on your machine; if that computer is turned off, orders are not sent.

If at the time of purchase the ZIP or the installer is not yet published in the dashboard, we send them to you by email at your account address. Access to those downloads ends when the license expires or is cancelled, just like the indicator.

9. What you can and cannot do with the license

We grant you a personal, non-transferable and non-exclusive license to use the product during the purchased period. You do not acquire ownership of the software.

You may not:

• Share, lend, rent, resell or sublicense your access.
• Publish, extract, decompile or reverse engineer the code.
• Create derivative products or signal services based on the indicator.
• Use the product for unlawful activities or activities contrary to these terms.

Detecting any of these behaviors is grounds for immediate removal of access, with no right to a refund.

10. Availability

We depend on third parties we do not control: TradingView, your broker, your execution platform and the messaging services through which alerts arrive. We will do what is reasonable to keep the service available, but we cannot guarantee uninterrupted operation or be held responsible for outages on their side.

11. Warranty and refunds

We are responsible for the suitability (idoneidad) of the product under the Consumer Protection and Defense Code (Law No. 29571): what we deliver must work as we describe it. If it does not, fixing it or refunding your money is our obligation, not a favor, and that right does not expire with the commercial period in the next paragraph.

12. Limitation of liability

To the extent permitted by law, we are not liable for trading losses, lost profits, lost opportunities or indirect damages arising from the use of the product or the inability to use it. Our total liability to you will not exceed the amount you paid us in the 12 months prior to the event giving rise to it.

Nothing above limits liability that cannot be limited by law, nor liability arising from willful misconduct (dolo).

13. Intellectual property

The indicator, the extensions, the Fundrbot brand, and the texts and design of this site belong to us. Your license does not transfer any of those rights to you.

14. Suspension and termination

You can stop using the service whenever you want. We may suspend or cancel your access if you breach these terms, if the payment is reversed or if we detect fraud. When the cancellation is not due to a breach on your part, we will refund you the unused proportional amount.

15. Changes to these terms

We may update them. If the change is significant, we will notify you by email with reasonable advance notice and it will be reflected in the date at the top. Changes do not apply retroactively to licenses already purchased.

16. Governing law, complaints and jurisdiction

These terms are governed by the laws of the Republic of Peru. Before turning to other channels, you can use our Complaints Book (Libro de Reclamaciones), which we answer within a maximum of 15 business days, or file your complaint with INDECOPI. For any dispute not resolved in this way, the parties submit to the judges and courts of the judicial district corresponding to the consumer's domicile.
